Terms of Service

These Terms of Service ("Terms") govern your use of the smartifie.com website, the software products, applications and services offered under the Smartifie brand (collectively, the "Services"). By using the Services you agree to these Terms. If you do not agree, please do not use the Services.

1. Provider Information

The Services are provided by Birileri Dış Ticaret Danışmanlık Sanayi ve Ticaret Limited Şirketi ("Smartifie", "we"). Contact: info@@smartifie.com.

2. Accounts

Some Services require you to create an account. You are responsible for keeping your credentials confidential and for all activity under your account. You agree that the information you provide is accurate and kept up to date.

3. Licenses and Permitted Use

When you purchase or subscribe to a software product, you are granted a personal or organizational, non-transferable, non-exclusive license to use it, subject to the fee paid and the product variant you selected (Windows, Android, iOS, macOS or cross-platform). You may not reverse engineer, decompile, resell, or reproduce the software beyond the scope of your license.

4. Payments and Subscriptions

Fees are charged at the prices stated on the product page. Subscriptions renew automatically for the term you selected (monthly/annually) until cancelled. You may cancel your subscription at any time from your account dashboard; cancellation takes effect at the end of the current billing period. Refunds are subject to our Refund Policy.

Our products may also be offered through third-party channels such as Google Play, the Apple App Store, Trendyol and Amazon. Purchases made through those channels are additionally subject to that channel's own terms and payment/refund rules.

5. Intellectual Property

All software, source code, designs, trademarks, logos and content related to the Services belong to Smartifie or its licensors and are protected by applicable intellectual property law. No rights are transferred to you other than the license granted.

6. Acceptable Use

You may not use the Services in any way that violates applicable law, infringes the rights of others, or compromises the security or integrity of the Services.

7. Limitation of Liability

To the maximum extent permitted by applicable law, the Services are provided "as is". Smartifie shall not be liable for indirect, incidental or consequential damages, loss of data or loss of profit, to the extent permitted by law. This does not affect your mandatory rights under consumer law.

8. Termination

We may suspend or terminate your access to your account or the Services if you breach these Terms. You may end this agreement at any time by cancelling your subscription.

9. Changes

We may update these Terms from time to time. We will give reasonable notice of material changes. Continuing to use the Services after changes take effect means you accept the updated Terms.

10. Governing Law

These Terms are governed by the laws of the Republic of Türkiye. For consumer transactions, the competent consumer arbitration committees and consumer courts have jurisdiction.
