Start Stop Product Terms

Terms specific to customers who use Smartifie Start Stop: limits concerning working-time records and employer obligations.

Version v1.0 · Last updated: 4 November 2026

These Product Terms apply only to customers who use Smartifie Start Stop ("Start Stop") and supplement the Terms of Service. In every matter not covered here — including the limitation of liability — the Terms of Service apply.

1. The product is a tool. Smartifie Start Stop ("Start Stop") is software that helps you record start, pause and finish times per work order and operation, stop reasons and production quantities. Start Stop records the time of work started and stopped on the terminal, not the time of arrival at or departure from the workplace.

2. Employer obligations remain with you. Documenting your employees' working time in accordance with the law that applies to you; keeping the records for the period and in the form that law requires; giving access to the records to your employees and — where the law so provides — to their legal representatives; producing the records to inspection authorities; actually granting rest breaks; and informing your employees about their personal data are your obligations as employer. Your use of Start Stop transfers none of these obligations to us.

3. No compliance or certification warranty. We do not warrant that Start Stop meets the form, content, retention or access requirements of any country's working-time recording legislation. Start Stop has not been approved, registered or certified by any public authority or body. In particular: (a) Start Stop is not offered as an approved or certified working-time (time-and-attendance) recording system; we give no undertaking that it meets the requirements of, or replaces, a recording system prescribed by any legislation, including Spain's working-time record (registro de jornada). (b) Start Stop is not offered to customers in Brazil; it is not an electronic time-recording system (registro eletrônico de ponto — REP-C, REP-A or REP-P) within the meaning of Portaria MTP nº 671/2021 and carries no INPI registration, no record file signed with an ICP-Brasil certificate and none of the technical documents that regulation requires. (c) Data protection authorities do not approve software; we give no undertaking that Start Stop is "approved" or "compliant" with any particular data protection law. Start Stop offers features that make lawful use easier (such as processing no biometric data, per-person reports being off by default, and anonymisation at the end of the retention period); assessing whether these are sufficient at your workplace is your responsibility.

4. Calculated breaks. When breaks are deducted using the "calculated" method, Start Stop does not measure the break; it assumes the break window you defined in the shift calendar, deducts it, and labels it "calculated" in the records. Such a record does not show that the break was actually taken. Defining shifts and breaks correctly and actually granting breaks is your responsibility.

5. Your settings and inputs. The accuracy of the records depends on elements you determine, such as your shift calendar, break method, time-zone setting, the clocks of terminal devices, operators acting under their own identity, corrections made by your authorised users and the backdating permissions you grant; the consequences of those elements are yours. In the Single Terminal (device) installation the records stay on the terminal device and backing them up is your responsibility.

6. Employee data. You are the controller of your employees' personal data processed in Start Stop. In the Cloud and Private Database installations we process that data on your behalf and on your instructions as processor; in the Single Terminal and Own Database installations that data does not reach us. We provide you with a sample operator privacy notice; this sample does not replace your own privacy notice, and adapting it and giving it to your employees is your responsibility. When you switch on per-person reports you confirm that you have informed your employees; the accuracy of that confirmation is your responsibility.
